1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Stack.WS Time Machine (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. If changes are material, we’ll take reasonable steps to notify you. Your continued use of the Service after changes become effective constitutes acceptance.

2. Eligibility & Accounts

You must have the legal capacity to enter into these Terms. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Acceptable Use

You agree not to misuse the Service. For example, you will not: (a) violate any applicable law or third-party rights; (b) access or probe non-public areas or systems; (c) interfere with or disrupt users, hosts, or networks; (d) attempt to bypass rate limits or security; (e) use automated scraping that burdens the Service; (f) upload, transmit, or link to malicious code; or (g) use the Service to store or transmit unlawful content.

4. Archiving Service & Content

The Service provides access to historical snapshots sourced from third-party archives and/or captures initiated by the Service. Snapshots may contain third-party content that is not owned or controlled by Stack.WS. We do not guarantee completeness, accuracy, availability, or legality of any snapshot.

You are responsible for how you use snapshots, including complying with applicable copyright, trademark, privacy, and website terms. If you believe content accessible via the Service infringes your rights, please contact us (see Contact).

5. Intellectual Property

The Service, including its UI, software, and branding, is owned by or licensed to Stack.WS and is protected by IP laws. Except for rights expressly granted to you to use the Service in accordance with these Terms, we reserve all rights. You retain any rights you have in content you submit to the Service, if applicable.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and disclose information. By using the Service, you consent to our data practices as described there.

7. Availability, Changes & Beta

The Service may change or be discontinued at any time without notice. Features may be added, modified, or removed. During the beta period, performance, features, and limits may change frequently and issues may occur (including failed loads, incomplete results, or downtime).

8. Fees & Refunds

Unless otherwise stated, the beta is offered without charge. If we introduce paid plans or usage-based fees, we will provide details at the point of purchase. Except where required by law, fees are non-refundable once service is delivered.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACK.WS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACK.WS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

11. Indemnification

You will indemnify and hold harmless Stack.WS and its affiliates, officers, agents, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12. Suspension & Termination

We may suspend or terminate your access to the Service at any time, including if we reasonably believe you have violated these Terms or are creating risk or possible legal exposure for us or others.

13. General Terms

These Terms constitute the entire agreement between you and Stack.WS regarding the Service and supersede any prior agreements on the subject. If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
